Any offer made by iImage, LLC Inc. to sell goods is subject to these terms and conditions, and, unless otherwise expressly agreed by iImage, LLC in writing, any different or additional terms and conditions proposed by the purchaser are hereby objected to and rejected and shall be of no effect

Order Processing
iImage, LLC prints orders as they are; Meaning, we will process the order according to how it was received and will make no adjustments to the order unless it is noted. In that case, there will be additional charges for adjustments in the picture pending on the degree of changes, which we will do to the best of our ability.

Content
iImage, LLC will not be liable for the content of any submission. We process orders as they are received.

Reprints
iImage, LLC guarantees that the development of your prints to be consistent with kodak development standards and if there is discolorations or toner irregularities we will be happy to reprint them for you at no additional cost. If you are not satisfied with your print order, please email us within 15 days from the purchase date. An email is necessary in order to initiate the reprint policy.  Please note that a reprints will be given on a case by case basis and will be dependent upon our order process and content policy. If you choose to have an order redone, there will be no option for a refund of your order on your credit card and your original shipping charges will not be refunded or credited to you.

Prices
All prices unless otherwise specified, are paid in full prior to delivery as designated by iImage, LLC. Prices do not include, and the purchaser shall pay any and all excise, sale, or use taxes. Prices and specifications are subject to change without notice. Some prices subject to quantities and availability. iImage, LLC is not responsible for typographic or display errors. All orders are subject to final acceptance by iImage, LLC and iImage, LLC reserves the right, in its sole discretion, to reject any order. Prices good for mail order and e-commerce only. In-Store prices may be different. Nevada residents may be subject to sales tax depending on what is purchased.

All prices will be at the rates in effect at the time the charges were incurred. All prices are displayed in U.S. dollars. We reserve the right to not honor old price lists.

Payment Terms
Our payment term for individuals and non rated firms and organizations is the submission of the remittance with order. We accept check, money order, and most major bank cards (Visa, Master Card, American Express and Discover). All prepaid amounts and or deposits received are non refundable and can only be applied as credit towards any photo package of there wedding. All deposits will be forfeit if wedding date is cancelled. Wedding dates may be changed and any and all payments will be applied to the new wedding date.

METHOD OF PAYMENTS

Check or Money Order
Personal checks may delay shipment pending check clearance.

Credit Card
We accept Visa, Master Card, American Express and Discover. Be sure to include account number, expiration date, card holder name as it appears on the card, and billing address of card holder if different from shipping address. Your credit card is not charged until the merchandise is shipped. Orders may be held pending cardholder verification.

Payment Plans
On all payment plans in good standing will be payable according to the terms and agreements of the contract. Past due balance may be subject to 1.5% service charge after thirty (30) days, which is an annual percentage of 18%. For information regarding this, contact our Office at 702-369-9600.

Prepayments
We accept prepayments for wedding packages purchased prior to the wedding date to secure photographers and equipment necessary for the event request and or is due to receive a discounted price for pre buying their digital negatives with print rights prior to their wedding date.

Shipping and Handling Charges
We ship United Parcel Ground Service whenever possible. We bill actual shipping charges plus appropriate handling and insurance. You may also request delivery by one of the rapid delivery carriers. The additional freight charges will be added to your invoice.

Delivery
Total delivery time equals merchandise availability plus shipping time. All delivery dates are approximate and iImage, LLC shall have no liability to the purchaser for late deliveries. Unless otherwise stated delivery of goods to the purchaser shall be sent certified through USPS by iImage, LLC. (Purchaser pays the freight cost from the point of shipment to the destination.) If you would like us to use another method of delivery, Please let us know your desired method of delivery. Note: UPS will not deliver to Post Office Boxes.

Warranty
Upon Receipt Of Your Purchase (Images and Photographs): Save your packing slip and invoice. You have a 30 day defect warranty.

Shipping and Handling Charges
iImage, LLC will not be held liable for damages caused by shipping. We package our orders appropriately so there should be no issue concerning the packaging itself. Should your order arrive damaged, stop unpacking. Save the shipping carton and all packaging included with your merchandise just as you received it. Notify our customer service department immediately for further instructions. Damages must be reported within 3 days of receipt of merchandise. iImage, LLC will not be responsible for any form of relief unless damages are reported within 3 days of receipt of merchandise.

Misprints
We make every effort to ensure the accuracy of all information printed or displayed. We reserve the right to correct any errors, whether in pricing, description, specifications, pictures, etc. iImage, LLC is not responsible for typographic or technical errors.

Force Majeure
iImage, LLC shall have no liability to the purchaser for any delay or failure in carrying out its obligations to the purchaser for reasons beyond iImage, LLC’s control, including without limitation, acts of God, war, natural disasters, charges in or compliance with laws, regulations or governmental policies and shortages of supplies and services. iImage, LLC may extend delivery of an order so affected without liability to the purchaser except for the return of any payment made by the purchaser to iImage, LLC with respect to any undelivered portion of the order so canceled.

Miscellaneous
The headings contained in these terms and conditions are for convenience only and do not in any way interpret, limit or amplify the scope, extent or intent of any of the provisions. These terms and conditions and any contract of sale between iImage, LLC and the purchaser shall be governed by the laws of the State of Nevada.

General
Your use of the digital photo files service must not infringe the legal rights of any other person (including privacy and personality rights, copyright, trademark, trade secret, patent, privacy, moral rights, and other proprietary rights). Under no circumstances, including but not limited to negligence, shall iImage, LLC, its affiliates, or its agents be liable for any indirect, incidental, special or consequential damages that result from the use of, or the inability to use the services described.

Inappropriate Images
Obscene or Objectionable Photos You may not upload to iImage, LLC (iimagephotography.com) any images or photographs which contain material that is unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane, indecent, including without limitation any transmissions that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, national or international law. You understand that iImage, LLC has no obligation to monitor the photographs. However, iImage, LLC reserves the right at all time to review the photographs (images), to disclose the photographs (images) as necessary to satisfy any law, regulation or governmental request, to refuse to post or transmit the photographs (images), and to remove any photographs (images) than in iImage’s sole discretion are objectionable or in violation of its guidelines.

Right of Refusal
iImage, LLC (iimagephotography.com) reserves the right to refuse to reproduce pictures, CD’s or any other media depicting aberrant or sexual conduct even if such photos are not illegal. If photos appear to be lawful, but are objectionable, discretion will be used to determine whether to complete the order and send it to the customer.

Copyright Disclaimer
Copyright Federal Copyright laws prohibit the re-creation of any image without proof of copyright ownership. Any image created by someone other than the holder requires written notification of a copyright release before any reproductions of any type may be made. Severe fines and penalties may be imposed for any copyright violations. It is the policy of this store to respect Federal Copyright Laws and the rights of the copyright owners. We will not knowingly violate Federal Copyright Laws.

Federal Copyright Law
OiImage, LLC reserves the right to refuse to reproduce pictures, files, images, CD’s or any other media if such material appears to be in violation of the Federal Copyright laws.

Storage Disclaimer
Your use of the iImage, LLC digital photo files service, including any materials, data or information posted, submitted, downloaded or otherwise obtained through the service, is at your own risk. The digital photo files service is neither designed nor is it intended to be used as a disaster recovery facility, archival backup facility, storage facility, or as an emergency data storage facility. Although iImage, LLC and its service providers take reasonable precautions to preserve and protect the material (files, images, photographs, etc.) that you may upload to the service, you should not rely on the service as your only source for the material you provide. You should keep your own backup copies of all materials that you may use, or allow others to use, in connection with the service, including materials posted or submitted to the service.

Disclaimer
Please backup all your image or data. iImage, LLC is not responsible for any damages or loss of images which includes films and any form of digital media. iImage, LLC disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. iImage, LLC does not warranty that the services described in this agreement will be uninterrupted or error-free, that defects will be corrected, or that the iImage, LLC digital photo files web site, or the server that makes it available, are free of computer viruses or other harmful components. Links and pointers may be provided to other web sites maintained by third parties. iImage, LLC does not operate or control in any respect, and is not liable for, any information, products or services on these third-party web sites. The materials in this web site and the third-party web sites are provided “as is” and without warranties of any kind either expressed or implied.

Limitation of Liability
Under no circumstances, including but not limited to negligence shall iImage, LLC or its affiliates be liable for any indirect, incidental, special, or consequential damages that result from the use of or the inability to use the services described in this agreement. iImage, LLC’s liability is limited to providing you with one roll of film and processing, or one free upload of a roll of film.
